Online Loan Application - Conditions

Each applicant, submitting this form electronically, the applicant/s acknowledge understanding of, and consent to the Declaration, and credit check authorisation, agrees to Black and White Motor Company Finance (BWMCF), (a division of Black and White Motor Company Ltd) and acknowledges as follows:

1) BWMCF, with its principal office at 461 Wilsons Road, Waltham, Christchurch 8011, New Zealand is collecting and will hold personal information about me/us to consider this finance application, and if approved, thereafter to determine whether or not to continue to make such finance available to me/us. BWMCF may use information collected about me/us for marketing, and promotional purposes, and generally to carry out BWMCF’s usual business functions.

2) BWMCF may disclose to a credit reporting agency or a debt collection agency any personal information about me/us that BWMCF holds including information contained in this application; my/our identification; the amount of credit approved; payments that may become overdue; advice that payments are no longer overdue; and any serious infringement which BWMCF believes I/we have committed. BWF, in assessing this application, any later request for a credit limit increase, and monitoring my/our credit status, may obtain from a credit-reporting agency personal credit information about me/us including credit reports containing information about my/our commercial activities or commercial creditworthiness. BWMCF may give to and obtain from any third party, information about my/our personal or commercial credit arrangements including information about my/our Ministry of Justice fines status, creditworthiness, credit standing, credit history or credit capacity for the particular purpose which the information is required. Driver Check allows the Lender to access your driver licence information including classes, endorsements, conditions, and status. BWMCF reserves the right to recheck your license during the term of the loan. I/we acknowledge, and agree that information disclosed to credit reporting agencies will be held by each agency on its system, accessed by customers of the credit reporting agency and used by the credit reporting agency to provide its services.

3) Under the Privacy Act 2020, I/we have rights of access to, or correction of, any personal information about me/us held by BWMCF.

4) BWMCF, and any of its related companies may send me/us commercial electronic messages for any of the purposes contemplated in this declaration.

5) I/we are not subject to bankruptcy proceedings or have arranged with creditors.

6) I/we understand my/our application may not receive full consideration unless I/we supply all information requested.

7) I/we declare the information provided in this application is true and correct, that I am/we are over the age of 18 and that I/we have read and understood these terms.

8) I/we authorise BWMCF to enquire/change and update information from my/our insurance company, and agree to BWMCF being noted as an interested party for the loan term.

9) I/we declare that I/we have disclosed to you all of my/our financial obligations arising under a loan facility, credit card, hire purchase contract or similar financing arrangement and all contingent obligations under any guarantee and certify that I/we can meet all payment obligations under my/our existing financial commitments, and the repayments for this loan.

10) I/we grant BWMCF permission to contact a creditor or secured party about assets or property that may be affected by security arrangements required under this application for finance. I/We certify that this application's information is correct and that I/we have read and understood the terms and conditions of this application.
